An experienced commercial litigator and client advocate, David brings enthusiasm and ingenuity to his clients’ legal disputes. David views every stage of every dispute—from pre-litigation through trial—as a unique opportunity to further important client objectives.

As a partner in BFKN’s Litigation Group, David has guided clients through a wide range of commercial litigation matters. David has handled all phases of legal disputes, from pre-litigation through trial preparation, has briefed and argued a variety of motions in court, and has conducted depositions of key witnesses. His experience covers multiple areas of law, involving real property disputes, motor vehicle franchise law, ERISA claims, trademark disputes, and other commercial matters. He has represented commercial landlords, fashion brands, automotive manufacturers, and telecommunications companies. David also maintains an active pro bono practice, including representation of incarcerated persons in prisoners’ rights matters.

Experience

  • Represented Christian Dior in a proposed class-action lawsuit claiming violation of the Illinois Biometric Information Privacy Act (BIPA) in the Northern District of Illinois. Secured motion to dismiss the complaint on the basis that Dior’s conduct falls within BIPA’s statutory “healthcare” exemption. Warmack-Stillwell v. Christian Dior Inc.
  • Represented a lender and successfully secured dismissal of federal-court claims relating to possession of a multi-million-dollar residence.
  • Pursued damages claims on behalf of commercial landlords relating to maintenance of, and damage to, commercial premises.
  • Defended fashion brands in trademark disputes in federal court and represented multiple clients in trademark matters before the Trademark Trial and Appeal Board.
  • Defended retailers and fashion brands in multiple class action lawsuits alleging Biometric Information Privacy Act (BIPA) violations based on augmented reality technology.
  • Represented automotive manufacturers in numerous franchise disputes, including litigation with franchisees in state and federal court and matters before state motor vehicle boards.
  • Represented an insurance policyholder in coverage litigation regarding data protection and business interruption losses under a cyber policy stemming from a ransomware attack on the policyholder.
  • Advised telecommunications clients in matters related to, among other things, rooftop leases and exercises of state eminent domain power.
