Barack Ferrazzano Intellectual Property Group Partner Thomas M. Williams has released the 2026 edition of his book, False Advertising and the Lanham Act, through LexisNexis. The updated edition provides a comprehensive review of false advertising jurisprudence under Section 43(a) of the Lanham Act, highlighting key decisions in which courts have developed critical analytical frameworks to interpret the statute’s limited language.

The 2026 edition also features current analysis of how courts are applying several recent U.S. Supreme Court rulings that have meaningfully shaped Lanham Act litigation, including the Court’s decision in Romag Fasteners rejecting willfulness as a prerequisite to an award of disgorgement of profits. In addition, the book addresses evolving case law regarding the puffery defense and the important distinction between advertising claims grounded in verifiable fact and those that constitute nonactionable opinion.
