Matt enjoys bringing his broad spectrum of experience to bear for sophisticated real estate industry clients. His insight into real estate development, acquisitions, financing, joint ventures, and leasing deals comes from extensive experience across asset classes in multiple jurisdictions. What sets Matt apart, however, is his years-long foundation across multiple areas of property law.

Matt is a partner in Barack Ferrazzano’s Real Estate Group. Matt’s deep and varied transactional experience is backed by first-chair work in real estate and land use litigation and administrative proceedings, foreclosures, and workouts for lenders and borrowers, the representation of public and private entities in bond issuances (including special district and homeowner association bonds), and the real estate aspects of wind and solar projects.

Matt applies his experience to clients’ bread-and-butter deals, as well as their ventures that feel like a stair-stepper contest. He values his longstanding client relationships and enjoys building close relationships between the firm and his clients’ internal teams.

Matt is currently based in the firm’s Chicago office, but he has worked in Southern California, New Mexico, and Jackson, Wyoming.

Experience

Acquisitions

  • Lead outside counsel in relation to the acquisition of thousands of vacant acres from a special district bond foreclosure, including multiple financings (mortgage and mezzanine) of that land, with urgency around each of them, a negotiated development agreement with the county, subdivision and entitlement review work, acquisitions and transfers of development rights, bulk sales, conservation easement structuring, individual lot sales, horizontal infrastructure contracting, and establishment of a captive construction subcontractor.

Development

  • Represented a REIT in its development of a mixed-use park, which included the land acquisition, financing (acquisition, construction and permanent), entitlement review and negotiation, subdivision, covenants, build-to-suit leases, construction contracting, negotiation of a railroad crossing, leasing, and sale.

Logistics

  • Financing of acquisitions and construction projects for multiple logistics companies. Leasing and acquisition/disposition work on the same.

Hospitality

  • Purchase of a hotel and campground that needed updating, and which involved acquisition and renovation debt, obtaining additional entitlements, negotiation of a 50-member joint venture agreement, and local permitting work.

Utility Scale Renewable Energy

  • Represented developers, tax equity, and lenders in relation to real estate leasing, easement negotiation, property-secured financing, and incentive negotiations in relation to wind and solar projects in New Mexico, California, Wyoming, and Montana.
