Client Alert: Protect Your Trademark from Registration as a .XXX Domain
Earlier this year, ICANN, the party responsible for managing top-level domain names such as .com, .org and .gov, approved .xxx as a top-level domain. As its name indicates, .xxx is intended for use by the online adult entertainment industry (sometimes referred to as the "sponsored community"). The .xxx domain is expected to be launched later this year, and beginning in September 2011, .xxx domain names will become available for registration.
The introduction of .xxx top-level domains creates a risk to trademark owners outside of the sponsored community that their brands may, through improper registration under a .xxx domain, become associated with the content of adult entertainment websites. Although safeguards will be put in place to limit abusive or infringing registrations, trademark owners should be proactive in preventing unauthorized registration of their marks under a .xxx domain.
The firm's IP Group has prepared the following Client Action Alert to help trademark owners protect their brands from unauthorized registration as .xxx sites, including guidelines for submitting marks to be "opted-out" of availability for registration as .xxx domains.
