Client Alert: New Non-Discrimination Rules for Insured Health Plans

The recently passed health care reform law - The Patient Protection and Affordable Care Act - includes provisions that prohibit discriminating in favor of highly compensated employees and former employees under a fully insured group health plan that is not grandfathered under the new law.  While this has historically been the case for self-insured plans, the non-discrimination rules did not previously apply to fully insured plans.

The Compensation and Employment Group of the firm has prepared a brief Client Alert highlighting how this prohibition may apply to your company, explaining enforcement of the prohibition and suggesting steps to be taken to address the new rules.

Please click below to read the Client Alert, and feel free to contact any member of the group for further information.
