Client Alert: New Non-Discrimination Rules for Insured Health Plans

The recently passed health care reform law - The Patient Protection and Affordable Care Act - includes provisions that prohibit discriminating in favor of highly compensated employees and former employees under a fully insured group health plan that is not grandfathered under the new law.  While this has historically been the case for self-insured plans, the non-discrimination rules did not previously apply to fully insured plans.
