The Present and the Future of BIPA
On Tuesday September 21st, Barack Ferrazzano Litigation Group partner Connor T. Gants joined the Chicago Bar Association’s Cyber Law & Data Privacy Committee for a webinar to discuss “The Present and the Future of BIPA.” Connor’s presentation addressed common challenges facing BIPA defendants as well as more novel issues, such as how the law applies to innovative technologies like augmented reality and the scope of its exception for government contractors. It also addressed potential defense strategies, such as moving to dismiss certain claims for punitive damages or to arbitrate. Finally, Connor addressed recent developments regarding the applicable statute of limitations, preemption under various labor laws, and standing in federal court. Connor presented alongside Illinois State Senator Jason Barickman, the author of legislation that would amend BIPA, as well as Professor Charlotte Tschider of Loyola University Chicago, a leading scholar and author in the field of data privacy.
