Kim concentrates her practice on commercial bankruptcies and creditor’s rights. She represents debtors, secured creditors, financial institutions, unsecured creditors, creditors’ committees, asset purchasers and lessors in all aspects of financial restructuring and bankruptcy. Prior to joining Barack Ferrazzano, Kim was Associate General Counsel for Bankruptcy and Collections at Sears Roebuck and Co., where she was responsible for leading the group that formulated, oversaw and revised all bankruptcy and collection policies and procedures for the company. Kim started her bankruptcy career as a law clerk for the Honorable Eugene R. Wedoff, United States Bankruptcy Judge for the Northern District of Illinois.
Representative Matters
- Kim often represents large suppliers to and customers of debtors in complex Chapter 11 cases, and recently has represented such parties on section 503(b)(9), reclamation, recoupment, setoff, and claim trading issues in large automotive and other manufacturing cases.
- Kim frequently counsels automobile and motorcycle manufacturers in dealer bankruptcies through the country, advising on stay relief, termination and asset purchase issues.
- Kim regularly counsels landlords on the consequences and ramifications of tenant bankruptcies.
- Kim has successfully defended numerous preference and fraudulent transfer cases for her clients throughout the country.
