Barack Ferrazzano is focused on the needs of our clients as they address the evolving debt crisis in the financial services industry, including the regulatory challenges faced by financial institutions attempting to repay their outstanding debt and the possibility of bankruptcy.
Over the last several years, we have actively represented both bank holding companies seeking to address their debt issues through bankruptcy and out-of-court restructurings, as well as creditors of financial institutions and investment funds seeking to protect their rights as creditors. Our representations have involved: advising parties on their strategic options in bankruptcy, including restructuring through a plan of reorganization; managing Section 363 sales, both as the debtor and as a stalking horse bidder; and representing clients in bankruptcy litigation. We also have broad experience defending and prosecuting involuntary bankruptcies, which have been used against financial institutions and will continue to be used in the future.
